Is AT protected under the Safe Harbor Provisions? (here ya go Vulkron)

Well, after some google searching, I think I've managed to find as many answers as I can. You can see my sources and all the excerpts I consider relevant here:

And the conclusions I have drawn from my research are thus:
There is no practical way to legally obtain permission to use copyrighted work for the vast majority of people,
Germany and the rest of europe don't follow any Fair Use Initiatives, (don't actually have any specific sources for this, but you can just google "german copyright fair use" and see all the links that out right state or imply it) and
Soundcloud is protected under Safe Harbor provisions in the Electronic Commerce Initiative of 2000

So the questions now are:
How is AT not protected under the Safe Harbor Provisions as well? Didn't the Cloud have a copyright infringement notification system? How did it not meet regulations? (I'll admit, I don't understand all the language in the requirements for information societies in the ECI, so I might well, be overlooking something) Would it help if we made all samples automatically hidden from the community? Since I understand a large part of this issue is the sharing of samples from royaltied sample packs.
And where are the complaints of copyright infringement coming from anyway? Are we allowed to know or is the staff legally prohibited from discussing details? I've heard mention of a law suit in the main thread. Was AT threatened with a lawsuit?
